AI in Film: The 2026 Compliance Landscape
Right of publicity, IP infringement, and trade dress for AI-generated film and short-drama content — what changed in 2025-2026 and what studios, platforms, and E&O carriers need to ship today.
The 2026 problem, in one paragraph
In late 2025, four things converged. Generative video tools (Sora, Veo, Kling, Hailuo, Runway Gen-4) reached photorealistic quality at consumer pricing. Vertical drama platforms — ReelShort, DramaBox, ShortMax, FlexTV, Goodshort — published over 20,000 new episodes per month between them. Distributors started requiring AI-content compliance documentation as a delivery condition. And major talent agencies, watching the “Bruce Willis deepfake scandal” settle in California courts, began sending cease-and-desists at industrial scale.
The work that fell out of those four trends — verifying that an AI-generated frame doesn’t resemble a celebrity, an anime character, or a copyrighted costume — used to take a paralegal a week per feature. It now needs to happen on every short-drama episode, every promo cut, every thumbnail. That is the gap this essay is about.
Right of publicity in four jurisdictions
United States
Right of publicity is state law in the US, and the substantive standard is California’s. California Civil Code § 3344 prohibits the unauthorized use of a person’s name, voice, signature, photograph, or likeness for commercial advantage, with statutory damages starting at $750 per use. The Lanham Act (15 U.S.C. § 1125(a)) layers a federal false-endorsement claim on top, which is what practitioners reach for when the defendant is out of state.
The 2024-2025 wave of AI-likeness rulings — most consequentially Young v. NeoCortex Inc. (C.D. Cal., 2025) — has held that statistical resemblance is sufficient for a § 3344 violation if a reasonable viewer would identify the plaintiff. You don’t need a name, a credit, or any human intent to imitate. The face is enough.
Practical consequence: AI-generated content that depicts a face statistically close to a public figure’s is exposed, even if the production team wasn’t aware of the resemblance. Compliance documentation that shows you ran a similarity scan and either rejected the shot or obtained consent is the cleanest defense.
European Union
The EU treats facial likeness through two overlapping regimes. GDPR Article 9 classifies biometric data — including a photograph used for biometric identification — as a special category requiring explicit consent or a narrow lawful basis. The newer EU AI Act (Regulation 2024/1689) adds transparency obligations: deepfakes must be labelled, and high-risk AI systems used for biometric identification must be registered.
For film content the practical question isn’t whether your AI shot is “personal data.” It’s whether a court would say a particular face on screen is biometric identification of a real person. The threshold hasn’t been litigated to a definitive standard yet, but the German DSK has issued guidance treating high-similarity AI-generated portraits as in-scope.
China
The 2021 Civil Code consolidated personality rights in Articles 1018-1019. Article 1019 specifically prohibits using information technology (the term used is 信息技术) to forge another person’s likeness or voice. The 2023 Cyberspace Administration of China rules on 深度合成 (deep synthesis) added a labelling requirement: any AI-generated content depicting real people must carry a visible “AI generated” mark.
Enforcement has accelerated through 2024-2025. TheWei Yi v. AI Company A Beijing Internet Court case held that AI-generated content using a celebrity’s likeness without consent infringes their personality rights even when no direct training data of the celebrity was used — the resemblance itself was enough.
Cross-border production note: distributors operating in China now require a 深度合成 compliance attestation as part of the content-licensing pack. The attestation needs to enumerate every AI-generated shot and certify that no real person’s likeness was used without consent.
Japan
Japan recognises personality rights through tort doctrine rather than statute. The leading case remains Pink Lady v. Kobunsha (Sup. Ct. 2012), which established that a portrait used commercially for “the purpose of attracting customers” infringes if the identity is the actor’s pull. The 2023 amendments to the Anti-Unfair Competition Act covering “digital fakes” sit on top of this — they criminalise deceptive AI-generated content of public figures used in commerce.
For Japanese-market distribution (especially anime tie-in merchandise), expect platforms to require a similarity-clear certificate that goes beyond what US distributors ask for. The bar for “identity used for attraction” is lower than the US “commercial advantage” standard.
IP infringement: anime, games, characters
Right-of-publicity protects real people. Copyright protects fictional characters — and the fictional-character bar is lower than people often think. Under DC Comics v. Towle (9th Cir. 2015), a character is copyrightable if it has consistent traits, distinctive attributes, and is “especially distinctive.” Pikachu, Naruto, and Cloud Strife all clear the bar comfortably.
The 2023-2025 wave of AI-styled characters (e.g. anime vtubers generated wholesale by SD-XL fine-tunes) ran repeatedly into this. Where the AI tool was trained on copyrighted character art, even the “generated” output isn’t a clean defense if the resemblance to a specific protected character is high. Japan’s 2024 guidance from JASRAC and the Bunkacho explicitly: training data may have a fair-use carve-out under Article 30-4 of Japanese copyright law, but inference output that resembles a registered character does not.
The compliance workflow most studios are converging on: before publishing AI-generated character content, run CLIP-based similarity matching against a reference set of registered characters from major IP holders. Anything flagged at >0.65 raw cosine similarity gets human review. Trade dress and costume similarity
Costumes occupy a strange corner. Pure costumes (a generic kimono, a generic spacesuit) aren’t copyrightable — Star Athletica v. Varsity Brands (2017) set the modern test for separability of design elements from useful articles. But specific iconic costumes can and do qualify for trade-dress protection under Lanham Act § 43(a). Examples that have been litigated: the Stormtrooper armour, the Power Rangers uniform, the Klingon battle dress, Wonder Woman’s gauntlets.
In the AI-content context, this matters because style transfer is unpredictable. A prompt for “galactic stormtrooper” won’t reliably produce something that avoids LucasFilm’s registered dress. Who’s pushing for documentation
E&O insurance carriers
Errors-and-omissions policies for film and TV traditionally priced based on cast clearances and music licenses. Carriers writing AI-content riders in 2025-2026 — Aon, Marsh, Allianz Entertainment, and a handful of Lloyds syndicates — are now requiring per-production AI similarity audits as a condition of binding the policy. If the audit isn’t run, the rider isn’t bound, and a likeness claim hits the production company’s general liability — usually uninsured for this exposure.
Distributors and platforms
Streamers (Netflix, Amazon Prime, Apple TV+) have updated their delivery specs to require an AI content disclosure accompanying any title containing AI-generated visual work. The disclosure isn’t a checkbox — it’s a jurisdiction-by-jurisdiction breakdown of what was generated, what was matched against, and what cleared.
Vertical-drama platforms moved faster. ReelShort, DramaBox, and ShortMax all updated their publisher agreements in late 2025 to require pre-publication compliance scans on any episode containing AI-generated face content. Failure to provide documentation triggers a takedown plus a per-episode penalty fee.
A practical compliance checklist
For a studio or platform shipping AI-generated film content in 2026, the minimum-viable workflow:
- Scan every frame against a celebrity likeness database before delivery. Calibrated face-similarity scoring; flag at the platform’s defined threshold, escalate at 85%+.
- Match against registered character IP for any animated or stylized content. CLIP-based cross-domain similarity is the right tool here; raw-cosine threshold around 0.65 is current best practice.
- Check costume / trade dress using weighted-region matching against a corpus of registered iconic costumes. This is the track most often missed because traditional clearance workflows don’t cover it.
- Generate per-jurisdiction risk reports listing every flagged shot, the controlling statute or precedent, and a recommended action (release / re-render / obtain consent). The report itself is the deliverable your distributor’s legal team will sign off on.
- Retain the reports for the policy term of your E&O coverage. If the carrier or distributor asks for documentation a year later, you’ll need it.
